Changes to the Owners Corporations Act 2006 now allow Body Corporates to ban short-stay accommodations in their buildings.
The Owners Corporations Act 2006 has been amended by the Short Stay Levy Act 2024 which came into effect on 1 January 2025.
Owners Corporations (‘OC’) can now impose special rules which include prohibition on use of lots as short-stay accommodation (but not if the lot is the principal place of residence of the owner or lessee).
Amending the rules requires a special resolution of the OC, requiring either 75% of the total votes / entitlements of the OC to agree, or at least 50% to agree and no more than 25% to disagree.

The new legislation is expected to impact the high-end residential apartment buildings PILOT manages for our clients on the Mornington Peninsula and Inner South East Melbourne suburbs.
Other clients in the Peninsula area may continue to enjoy the flexibility of a variety of accommodation types, including mostly holiday accommodation, particularly on the southern end of the Peninsula.
The controversial new legislation introduces a short stay levy of 7.5% of the total accommodation cost for stays under 28 days, which is paid by the property owners.
This levy does not apply to properties that are the owner's principal place of residence, such as when you rent out your apartment while on holidays.
